At Schouwburg Concertzaal Tilburg, we apply the general visitor terms and conditions of the Association of Theatre and Concert Hall Directors (VSCD). These terms and conditions are available on request from our Box Office or can be viewed on the VSCD website.
Application of General Terms and Conditions for Visitors
These General Terms and Conditions for Visitors apply to every agreement between Schouwburg Concertzaal Tilburg and a visitor to Schouwburg Concertzaal Tilburg. These General Terms and Conditions for Visitors also apply to all actions performed in the execution of this agreement. For the purposes of these General Visitor Terms and Conditions, a visitor (hereinafter: “the Visitor”) is understood to mean any person or legal entity that, in any way, directly or indirectly, enters into an agreement with Schouwburg Concertzaal Tilburg regarding attendance at an event organised by the Theatre or by a third party in the Theatre building (hereinafter: ' the Building', which also includes that part of the public road adjacent to the Building to which the Theatre has any commercial rights) or another location used by the Theatre. In addition, these General Terms and Conditions for Visitors are declared applicable to anyone attending any event in the Building, without the person concerned having entered into an agreement with the Theatre, either directly or indirectly.
Tickets
All offers, programme announcements, communications or other information and quotations provided by Schouwburg & Concertzaal Tilburg or by third parties are without obligation. Schouwburg Concertzaal Tilburg accepts no liability for any errors in announcements, offers, communications or other information and quotations provided to the Visitor by Schouwburg Concertzaal Tilburg and third parties, or for errors made in the (pre-)sale of tickets by third parties, including the so-called advance sales addresses.
Entrance ticket
If requested, the Visitor is obliged at all times to show his/her entrance ticket and any card entitling him/her to a discount on this entrance ticket to officials of Schouwburg & Concertzaal Tilburg who are recognisable as such. The admission ticket must in any case be shown upon entering (the relevant area of) the Building, even if the Visitor has left (the relevant area of) the Building during (the duration of) an event.
Resale
The Visitor is obliged to keep the admission ticket for an event for themselves and therefore not to resell it to third parties in any way, offer it for sale or offer or provide it for commercial purposes.
The Visitor is obliged towards the Theatre not to advertise or publicise the event or any part thereof in any way if this is done with the intention of reselling the admission ticket, all this at the discretion of the Theatre. General Terms and Conditions for Visitors VSCD July 2012 2
Visitors who make their admission ticket available to third parties free of charge and not for commercial purposes are obliged to impose the obligations imposed on them as Visitors, as set out in the previous paragraphs of this article, on the person to whom they make the admission ticket available and to guarantee to Schouwburg Concertzaal Tilburg that this person (and) will comply with these obligations.
If the Visitor fails to comply with his obligations as set out in the previous paragraphs of this article and/or cannot guarantee this, the Visitor shall owe the Theatre an immediately payable penalty of €10,000 per violation and €5,000 for each day that the violation continues, without prejudice to the Theatre's right to claim compliance and/or compensation from the Visitor for the funds or damage still to be suffered.
Stay in the building
During his/her stay in the Building, the Visitor must behave in accordance with public order, morality and the rules of decency applicable to the nature of the event being attended. In this regard, the Visitor is also obliged to follow the directions and instructions given by the recognisable officials of Schouwburg & Concertzaal Tilburg. If, in the reasonable opinion of a senior official of the Theatre, the Visitor acts in any way contrary to these standards, directions or instructions, the Visitor may be denied further access to the Building for the event in question, without the Visitor being entitled to any refund of his/her admission ticket.
Visitors are prohibited from, among other things: a. offering goods and written information of any kind for sale or providing them free of charge to third parties in the Building without the express permission of the management; b. bringing pets or other animals into the Building; c. bring food and/or (alcoholic) beverages into the Building; d. bring dangerous and/or objects or substances that are a nuisance to visitors into the Building or carry them with them, in the opinion of an official of Schouwburg & Concertzaal Tilburg; e. bring drugs into the building and/or use them.
In special cases where general safety reasonably requires it, the management of Schouwburg & Concertzaal Tilburg may request to inspect the luggage and hand luggage carried by the Visitor. If deemed necessary, specially trained staff may also request the Visitor to cooperate with a security search. In the event of refusal to cooperate, the Visitor may be denied (further) access to the Building without the Visitor being entitled to a refund of the price of the admission ticket.
Visitors are prohibited from bringing photographic, video, film, audio, or other recording equipment into the Building without prior written permission from the management of Schouwburg & Concertzaal Tilburg, or from using such equipment without prior written permission from the management of the Theatre. Officials of Schouwburg Concertzaal Tilburg who are recognisable as such are authorised to demand the surrender of any equipment found and to take it into custody during the Visitor's stay in the Building. If the Visitor refuses to cooperate, they may be denied (further) access to the Building, without the Visitor being entitled to any refund of the price of the admission ticket.
Schouwburg & Concertzaal Tilburg reserves the right to make image and/or sound recordings of the event attended by the Visitor. The Visitor will not raise any copyright or other objections to the use of his portrait/likeness as part of the publication of the aforementioned events.
Smoking is prohibited in designated areas within the theatre. Visitors are required to comply with these smoking regulations. If the Visitor refuses to cooperate, the Building Manager is authorised to deny them (further) access to the Building, without the Visitor being entitled to any refund of the ticket price.
Liability
The Visitor's stay in the Building is at his/her own expense and risk.
Schouwburg & Concertzaal Tilburg is only liable for property damage and/or consequential damage suffered by the Visitor or injury caused to the Visitor that is directly and exclusively the result of intent or gross negligence on the part of Schouwburg Concertzaal Tilburg and/or its officials, on the understanding that only damage for which the Theatre is insured, or, in all reasonableness and fairness, should have been insured, is eligible for compensation, up to the maximum amount specified therein.
The liability of Schouwburg & Concertzaal Tilburg is excluded for, among other things:
- damage resulting from the actions of third parties, including persons engaged by Schouwburg & Concertzaal Tilburg and tenants of (spaces in) the Building and persons engaged by these third parties;
- damage resulting from failure to follow instructions given by Schouwburg Concertzaal Tilburg officials and from failure to comply with generally accepted rules of decency;
- (consequential) damage resulting from unforeseeable changes to the start and end times of the events to which the agreement between the Theatre and the Visitor relates;
damage caused in any way by other visitors.
Schouwburg & Concertzaal Tilburg is never liable for damage suffered by the Visitor as a result of force majeure on the part of the Theatre. Force majeure is understood to mean any circumstance beyond the control of the Theatre – even if this could already be foreseen at the time the agreement was concluded – that temporarily or permanently prevents the fulfilment of the agreement, as well as, insofar as not already included, war, acts of war, civil war, riots, riots, police and/or fire brigade action, strikes, transport difficulties, fire and other serious disruptions to the Theatre's business or the Building, weather conditions and public transport not functioning for any reason whatsoever.
Advertising / Complaints
Complaints about the performance of the agreement between Schouwburg & Concertzaal Tilburg and the Visitor must be sent by registered letter to the Theatre's management within eight days after the performance of the agreement took place or should have taken place. Complaints submitted after this period will not be considered by the Theatre.
Complaints cannot be made in relation to the following complaints and circumstances, and therefore never lead to any obligation on the part of the Theatre to pay compensation:
- complaints and circumstances relating to changes in the programme, including, but not limited to, changes in the person(s) performing, in the composition of the programme, or postponement of events to another date;
- complaints and circumstances relating to the quality of the performances of the events to which the agreement between the Theatre and the Visitor relates;
- complaints and circumstances relating to nuisance or inconvenience caused by other visitors or unlawful intruders, including but not limited to noise nuisance, inappropriate behaviour, theft and vandalism; in the event of repeated nuisance or inconvenience caused by certain visitors, to be identified in more detail, Schouwburg Concertzaal Tilburg will do everything possible to deny these visitors access in the future if necessary;
- complaints and circumstances relating to nuisance or inconvenience caused by maintenance work on the building, or to the consequences of such maintenance work that could reasonably be carried out at that time;
- complaints and circumstances relating to nuisance or inconvenience caused by the malfunctioning of facilities in the rooms of the building;
- complaints and circumstances relating to nuisance or inconvenience, including limited visibility for Visitors, caused by (sound) recordings by the media and the technical measures taken in the halls as a result;
- complaints and circumstances relating to noise nuisance caused by simultaneous events, including necessary activities in preparation for these events, or which are in any other way related to these events, in other areas of the building;
- complaints and circumstances relating to the allocation and distribution of seats and/or a change to the seating plan necessitated by circumstances;
- complaints and circumstances relating to nuisance or inconvenience, including limited visibility of the stage and surtitles;
- complaints and circumstances relating to the presence or absence of surtitles, caused by the malfunctioning of technical equipment or the decision by Schouwburg & Concertzaal Tilburg to offer or not to offer this facility;
- complaints and circumstances relating to nuisance or inconvenience caused by public transport strikes;
- complaints because the Visitor has been denied access to the hall due to the circumstances that the event in this hall has already commenced.
Personal data
Data relating to the Visitor, including data relating to the Visitor's name, address and place of residence, which is recorded by Schouwburg & Concertzaal Tilburg in connection with the provision of an admission ticket, will be included in a register within the meaning of the Personal Data Registration Act (WPR). The Theatre and/or the point of sale is the holder of this register.
The Theatre may ask visitors to identify themselves. If visitors are unable to show identification or refuse to do so, they may be denied access to the Theatre. In this case, the admission fee will not be refunded.

Rights of Schouwburg & Concertzaal Tilburg
In the event of a violation by the Visitor of one or more of the provisions set out in these general terms and conditions, Schouwburg & Concertzaal Tilburg is entitled to invalidate the admission ticket or to refuse the Visitor (further) access to the event without the Visitor being entitled to a refund of the admission ticket price (including service charges) paid to Schouwburg & Concertzaal Tilburg, whether or not via a (pre)sales address. Holders of invalidated admission tickets are not entitled to a refund.
If it is plausible that the admission ticket has been forged, Schouwburg & Concertzaal Tilburg is authorised to refuse the holder of this admission ticket (further) access to the event, without the Visitor or this holder being entitled to claim any compensation for any damage they may suffer as a result.
Applicable law
These General Terms and Conditions for Visitors and the agreement between the Visitor and the Theatre are governed by Dutch law.
